By using the NearbyGrid app or website (the "Service") you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility · Adults Only
You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service. You represent that you are an adult and may lawfully enter this agreement. We may require age assurance and will terminate accounts we believe belong to minors. We do not conduct criminal background checks; use caution and meet safely.
2. Your Account
You are responsible for your account, for keeping your credentials secure, and for activity under your account. Provide accurate information. Accounts are personal and non-transferable. Notify us promptly of any unauthorized use. Your public Map and Grid presence shows only the discovery headline you choose (never your account name). If you set an optional event display name, it is visible to members of the groups and events you join and to friends you accept — accepting a friend request shares your event display name with that friend.
3. Acceptable Use & Community Standards
You agree not to: post content that is illegal, harassing, hateful, threatening, or that depicts minors or non-consenting persons; impersonate others or use fake/AI-generated images of others ("deepfakes"); solicit or engage in prostitution, escorting, compensated dating, sugar arrangements, or commercial sex; buy, sell, or advertise; spam, scam, scrape, or use bots; share others' private information; or circumvent safety or security measures. You may not post sexually explicit, pornographic, obscene, nude, age-gated, violent, or unlawful content on public or broadcast surfaces, including public profiles/photos, group and event names, descriptions, covers, announcements, group/event chats, or text updates. Public images must be of you or ordinary-life content you are authorized to share. Text updates (SMS) must be transactional and relevant to the event or group, with no marketing or third-party content. Consensual adult content in a private album or one-to-one chat is governed by Section 4, not this public-content rule.
4. Private Content & Consent
You may share intimate images of yourself only through consensual, grant-based private albums or chats. Never share images of another person without their explicit, enthusiastic consent. Recipients must not capture, redistribute, or misuse content. Album access is always free; we never charge to view a specific person's content. Consent can be withdrawn at any time, and you may revoke album access at any time.
5. Safety, Moderation & Termination
We use automated checks for uploaded public images and broadcast content, narrow high-confidence bot/spam detection for new cold direct messages, and human review of content submitted in reports. Ordinary direct, group, and event messages are not read or AI-reviewed before they are sent. We provide tools to report and block users and may remove content or suspend or terminate accounts that violate these Terms, our Community Guidelines, or applicable law. We report child sexual abuse material to NCMEC and cooperate with law enforcement. We honor removal requests under the U.S. TAKE IT DOWN Act (see Privacy Policy).
Violation of these Terms or our Community Guidelines may result in immediate account termination. Paid subscriptions do not exempt users from these rules. Upon termination for violation, any remaining subscription time and credits are forfeited. NearbyGrid does not issue refunds for accounts closed due to guideline violations. Any refund requests must be submitted directly through Apple or Google in accordance with their respective policies. By creating an account, you represent that no previous account of yours was terminated for a violation. We may take reasonable steps to prevent future account creation by banned users, including device, email, phone, and IP-based restrictions.
6. Subscriptions & Purchases
Paid features are sold through the Apple App Store and Google Play and are billed by those platforms. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period; manage or cancel through your app-store account. Except where required by law, payments are non-refundable.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind. We do not guarantee the conduct of any user or the accuracy of any profile. Meeting people from the internet in the real world can lead to unexpected situations that we cannot control and are not responsible for. You interact with, and choose to meet, other users entirely at your own risk — meet in public, tell a friend, and read our Safety page first. NearbyGrid is a social and discovery service, not a background-check, identity-verification, or emergency-safety service; our obfuscated location is a privacy feature, not a precise or reliable locator. We do not conduct criminal background checks on users.
8. Limitation of Liability
To the fullest extent permitted by law, NearbyGrid will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability will not exceed the greater of the amount you paid us in the prior 12 months or US $50.
9. Disputes & Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws rules. Disputes will be resolved as described in this section (including any arbitration and class-action-waiver provisions presented at signup, where applicable).
10. Copyright & DMCA
NearbyGrid respects intellectual-property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated agent including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the material claimed to infringe and its location on the Service; (4) your contact information; (5) a statement of your good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that your notice is accurate and that you are authorized to act. We remove or disable access to infringing material and, in appropriate cases, terminate repeat infringers. You may submit a counter-notice to the same agent.
11. Data, Scraping & AI
You may not scrape, crawl, harvest, or otherwise collect data or content from the Service, and you may not use the Service or its content to train, fine-tune, or develop any machine-learning or AI model — in each case without our prior written permission. Automated access is prohibited except as we expressly allow.
